1      INTRODUCTION

1.1      These terms and conditions will apply when you place your order with us.
1.2      These terms and conditions make repeated use of certain terms which we have defined in condition 2.
1.3      Before you place your order, we reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on this website and it is your responsibility to read these terms and conditions on each occasion you use this website.
1.4      Please print these terms and conditions and any email we send you for future reference.

2      DEFINITIONS

2.1      In these terms and conditions:

  • we“, “us” or “our“: means Plantation Shutters Ltd (registered in England with company number 03070306),
  • goods“: means the goods confirmed in our order acceptance email;
  • order“: means your order made by you, using this website, to purchase goods from us;
  • website“: means this website with the address www.diy-plantation-shutters.co.uk;
  • you” or “your“: means you, the user of this website and/or purchaser of the goods;

3      SPECIFICATION OF GOODS

3.1      Using the “How to measure your windows” guide, it is your responsibility to provide us with exact measurements, suitable for your requirements. We shall not be responsible for your inaccurate measurements.
3.2      Once you place an order online, you will receive an order processing confirmation via email. It means that we received your order request and will be placing it within the next 24 hours providing we have processed and received payment in full – it may differ depending on public bank holidays and weekends. It is your responsibility to check that all personal details and product specs submitted are correct. If you would like to alter any of them, you’ll have to do so within the 24 hours bracket otherwise it will not be possible. Once your order is placed, you will receive a final confirmation describing everything related to your order as well as a lead time estimate. We cannot accept returns for refunds as we are not able to resell made to measure goods.
3.3      All measurements are manufactured in millimetres (MM) only.
3.4      All sizes and measurements stated by us in relation to the goods are approximate only.
3.5      All items are cut to size and will be accurate with working tolerances and variances of +/-5mm. Orders cannot be returned if within this limit.
3.6      We are unable to guarantee that the digitally produced images shown on the website:

  • Accurately reflect the colours, due to variations in light and colour between different computer monitors.
  • Will be the same from one item to another in the case of matching sets, due to slight variations in dye lots and age of orders placed.

4      PRICE

4.1      The price you pay is the price displayed on this website at the time we receive your order. Any price displayed on this website shall be subject to change at any time.
4.2      All prices are shown in UK £s sterling and include value added tax (where applicable) at the applicable current rate.
4.3      Whilst we try to ensure that all prices on this website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat your order as cancelled.

5      PAYMENT

5.1      We take full (100%) payment from you at the time you place your order via the given PayPal secured payment gateway. Please note that this payment is not an acceptance by us of your order or evidence of any contract.

6      ORDER PROCESS AND CONTRACT FORMATION

6.1      The steps required to create a contract of sale between you and us are as follows:

  • On this website, you will be guided through the process of placing your order by a series of simple instructions.
  • You will place your order by pressing the “Place Order” button during the checkout process.
  • Your order is always subject to our acceptance.
  • You will receive an order processing confirmation via email and it is your responsibility to check that all personal details and product specs information submitted are correct within 24 hours of order placement as we cannot accept claims based on incorrect measurements or products. We will then place your order with our manufacturer at which point you cannot cancel it any longer.
  • Where delivery of the goods is made to mainland UK, acceptance of your order and the completion of the contract between you and us will only take place when we issue your order confirmation email detailing the goods and the price and a reference to these terms and conditions.

6.2      Order status and delivery lead times can be checked by contacting us using the details on your order confirmation. We will also provide you with up to date order status through email in due time – approximately 8 weeks from the date of order confirmation email.

7      MINIMUM ORDER

7.1      There is no minimum order

8      DELIVERY

8.1      Delivery of goods can only be made to Mainland UK.
8.2      The address for delivery shall be the address as stated on the order confirmation unless otherwise agreed between the parties in writing.
8.3      All goods must be signed for by an adult aged 18 years or over on delivery.
8.4      Delivery charges and estimated lead times are detailed in this website and when you place your order. We make every effort to deliver your order within the estimated lead time communicated to you. However, delays are occasionally inevitable due to unforeseen factors.
8.5      You shall provide at its own expense adequate assistance for unloading goods at their place of delivery within a reasonable time from the arrival of the delivery vehicle. In the event of default we shall be liable for the additional cost of delivery or re-delivery thereby occasioned.
8.6      If a you fail to take delivery of the goods or any part of them on the due date for any reason whatsoever we will be entitled to charge for re-delivery and upon notice to you delivery will be deemed to have taken place and you will pay to us all costs and expenses including storage and insurance charges. Any delay or failure to deliver by us will not entitle you to refuse delivery, to repudiate the contract or ask for a cost deduction.
8.7      Risk of loss and damage to your order passes to you on the date when the goods are delivered or on the date of first attempted delivery by us. Once the goods are delivered and signed for either in good condition or unchecked, we cannot accept responsibility for any damage to said property.
8.8      If your order is damaged, please contact us within 5 days to process a claim for a replacement. Images may be requested for claim purposes, this does not affect your statutory rights. If you are missing any items from your delivery, please contact us within 5 days to process a claim for replacement.
8.9      Order statuses and delivery lead times can be checked by contacting us using the details on the website and your order confirmation. We also provide you with up to date order statuses through email in due time.

9      RETENTION OF TITLE

9.1      Title to any goods shall pass to you on delivery of the goods provided that we have processed and received payment in full for the goods.

10    SUBSTITUTE GOODS

10.1    We will never supply you with substitute goods.

11    CANCELLATION RIGHTS, REFUNDS AND RETURNS

11.1    The cancellation period ends 24 hours after you placed the order. You can cancel by calling us on +44 (0)20 8871 9222 or emailing us at sales@plantation-shutters.co.uk.
11.2    Where the goods are “made to measure” you shall have no right to amend or cancel your order or seek any refund of the price paid by you from us outside the stipulated time on condition 11.1. This is because when we receive your order, the manufacturing process will begin after 24 hours and the goods are manufactured to your exact specification, pursuant to The Consumer Contracts (information, cancellation and additional charges) Regulations 2013. This does not affect your statutory rights.
11.2    In regards to returns, we cannot accept returns as we are not able to resell made to measure goods.

12    WARRANTY

12.1    All of our goods are warranted against defects in manufacture and material from delivery for a period of:

  • 5 years in the case of “made to measure” shutters

12.2    Should any defect arise during any warranty period, we shall at our expense, repair or replace the defective goods (or any part of them) on a like for like basis, provided that the defect has not arisen as a result of:

  • fair wear and tear;
  • non domestic or business use;
  • the goods being installed except as otherwise in accordance with accompanying written instructions or good industry practice.

13    LIABILITY

13.1    All goods are sold to you on the following conditions and you must ensure that the following conditions are incorporated into any sub-contract made by you. We do not accept any responsibility arising from your failure to follow this condition.
13.2    All goods should be fully inspected prior to installation. You must check that the shutters are in accordance with the order confirmation both for colour and design prior to installation. We cannot accept responsibility in circumstances where you are not present at the delivery address.
13.3    Our Shutters will be defect free in materials or workmanship. As shutters are handmade, it is sometimes the case that there will be small defects on any shutter panel and should this scenario arise, Plantation Shutters will be happy to review such panels. If the defect is so minor that it doesn’t affect the performance of the shutter or can’t be clearly seen under ordinary light to two metres away, this this in any normal event will not constitute a defect.
13.4    We cannot guarantee the goods against fading especially as a result of exposure to sunlight where fading will occur (see Warranty). Our goods are not guaranteed against extreme damp or variable conditions.
13.5    We reserve the right to withdraw any products and colours at any time without prior notice and cannot be held responsible for any consequences, caused by the withdrawal of such products.
13.6    Under no circumstances except in respect of death or personal injury caused by our negligence does we accept liability for consequential Ioss, damage, costs or expenses, howsoever arising and any liability for any such consequential loss damage is hereby specifically excluded. Should a claim be made our liability is limited to the value of the order placed by the buyer.
13.7    We give no warranty as to the fitness of the product supplied for any purpose other than that of an internal window dressing as other installation and uses are at your risk.
13.8    Tolerance levels of overall panel specifications are plus or minus 2mm per individual panel, and the product will not be considered defective if failing within the size range. Warp on any component part, vertical or horizontal, shall not exceed 1mm per 300mm and shall not be considered defective if within this tolerance.
13.9    Limitations. It is recommended that panels be ordered within our normal specification range. For example, that panels above 1100mm in height are ordered with a divider rail, and that panel widths do not exceed 450mm. We may exceed the limitation at your request, but in doing so we cannot accept responsibility for problems that result.
13.10  We accept no responsibility for changes in any aspect of the window or window surround/window handles/alarms sensors/or any additions to window or the surround after the order has been placed. Any remakes required will also be charged for. The foregoing is in substitution for all other terms, expressed or implied relating to the quality or fitness for purpose, and all such terms are hereby excluded. This does not, however, affect your statutory rights.
13.11  Since our products are made to measure, no cancellation can be accepted after 24 hours of order placement has been placed. You are liable for the full value of the order.

14    JURISDICTION

14.1    Contracts with us shall in all respects to be constructed and operate as a contract made in England. You and us hereby accept the exclusive jurisdiction of the English or European Courts in relation to any dispute which may arise out of or in connection with the contract for the goods supplied thereunder save that either party to the contract may refer any dispute thereunder to the tribunal of arbitration of the London Chamber of Commerce.

15.1    Your privacy is very important to us. Please review our Privacy Policy which explains how we will use your personal information that you disclose to us when placing the order.
